01Operator and scope of these Terms
The service available at matchdays.store is operated by Matchdays (the “Operator” or “Matchdays”). Contact: info@matchdays.store.
These Terms constitute the terms for the provision of electronic services. They are made available free of charge before an Account is created and may be saved or printed. Acceptance of these Terms is required to create an Account and use transactional functions.
Platform means the Matchdays service, Usermeans a person using the Platform, Seller means a User publishing a Listing, and Buyer means a User entering into a sale contract with a Seller.
These Terms are supplemented, as applicable, by the Seller Terms, Subscription Terms, Returns and Complaints Policy, Acceptable Use Policy, Promotions, Points and Games Terms, Privacy Policy and Cookie Policy. A transaction or feature may also have specific rules presented before the User confirms it.
02Electronic services and technical requirements
The Operator may provide, in particular, the following services:
- browsing and searching Listings,
- maintaining a User Account, profile and collection,
- publishing Buy Now Listings and auctions,
- supporting carts, orders, messages, disputes and notifications,
- tools that assist with item descriptions, valuations and authenticity assessments,
- connections to third-party payment, shipping and video services,
- Arena games, points or promotional features where they are expressly shown as available under applicable rules.
To use the Platform, a User needs a device with internet access, a current JavaScript-enabled browser, an active email address and the ability to store necessary cookies or local data. Photo, video and LiveCam functions may require access to a camera and microphone and the relevant browser permissions.
The agreement for the free maintenance of an Account is concluded upon registration and acceptance of these Terms and continues for an indefinite period. A User may terminate it at any time by deleting the Account or sending a request to the Operator, subject to completion of ongoing transactions and any legal data-retention duties.
03User Account
An Account may be created by a person who is at least 18 years old and has legal capacity to enter into contracts. Registration details must be accurate, current and belong to the User. A person must not use multiple Accounts to circumvent restrictions or manipulate auctions, reviews or statistics.
The User is responsible for protecting their login details and should report any suspected Account takeover without delay. The Operator may require additional verification of identity, trader status, tax details or a payment account where necessary for security, payments, payouts or compliance with legal duties, including DAC7.
04Role of the Platform and Seller status
Unless a particular Listing expressly states otherwise, the Operator provides intermediary technology and the sale contract is entered into directly between the Seller and the Buyer. The Operator does not take ownership of the item and is not its seller.
Before publishing a Listing, a Seller declares whether they act as a trader or a private individual. This information should be visible to the Buyer before the contract is concluded. The Seller is responsible for the accuracy of the declaration. The Operator may verify and amend it after receiving reliable information.
- The Operator is responsible for operation of the Platform and its own services.
- The Seller is responsible for the Listing, legality and conformity of the item, shipping and obligations owed to the Buyer.
- The Buyer is responsible for accurate delivery details, timely payment and cooperation with delivery.
- A payment provider or carrier is responsible for its own services under the terms presented to the User.
05Listings and prohibited items
A Seller may offer only items they are legally entitled to dispose of. The description, photographs, price, condition, provenance, authenticity, size, defects and safety information must be complete and accurate.
The following are prohibited in particular:
- offering counterfeits as genuine products or concealing authenticity concerns,
- selling stolen, unlawful, dangerous or recalled items, or items infringing third-party rights,
- publishing another person’s data, photographs or marks without an appropriate legal basis,
- price manipulation, bidding on one’s own Listing, sham transactions and circumvention of Platform fees,
- discriminatory, threatening, fraudulent or pornographic content, spam or malware.
A trader offering a product to consumers must provide all legally required details about the trader, the manufacturer or responsible person in the EU, product identification and safety warnings.
06Purchases, auctions and sale contracts
Listing details, the total price, delivery costs, fees and the Seller’s status are presented before an order is placed. The sale contract is concluded at the point indicated in the checkout flow, after the Buyer clearly confirms the obligation to pay.
A bid placed in an auction may be binding under the conditions displayed before it is submitted. Artificially inflating the price is prohibited. An obvious technical or pricing error may justify cancelling an operation after the reason has been explained to the affected Users.
Details of each transaction and confirmation of the contract should be available in the User dashboard or supplied on a durable medium, such as by email.
07Prices, fees, payments and payouts
Current fees and commissions are displayed before a chargeable action and on the pricing page. An amount accepted for a transaction will not be changed retrospectively. The Seller is responsible for their own taxes and sales documents unless the law expressly places a duty on the Operator.
Payments and payouts may be processed by an authorised third-party payment service provider. Before a method is used, the User will be told the provider’s identity and applicable terms. Matchdays does not accept deposits or independently provide an escrow service unless this statement is expressly updated after a compliant solution is deployed.
The rules for holding, releasing, refunding or reversing a payment must match the process actually implemented and are presented before payment. The Operator may place an operation on hold to the extent permitted by law and its agreement with the payment provider, for example where fraud or a dispute is suspected.
A paid recurring plan is formed only through an enabled checkout that clearly states the price, billing interval, included benefits and cancellation method. Paid plans are additionally governed by the Subscription Terms. A plan shown as unavailable, disabled or "Coming soon" is not currently offered for purchase.
08Shipping and delivery
Available methods, price and estimated delivery time are displayed before purchase. The Seller is responsible for suitable packaging, timely dispatch, accurate shipment information and retaining proof of posting. The Buyer should inspect the parcel and promptly report damage or a missing item.
Labels or tracking may be provided by an external logistics provider. An estimated delivery time is not a guarantee unless a particular method expressly states otherwise.
09Consumer rights
If the Buyer is a consumer and the Seller is a trader, mandatory consumer law applies, including rules on pre-contract information, the right of withdrawal and conformity of goods with the contract. These Terms do not limit those rights.
Consumer law will generally not apply to a purchase from a private individual, including the statutory 14-day right of withdrawal. The Buyer must be informed of this before purchase.
An auction conducted exclusively online is not, for that reason alone, a “public auction” excluded from the right of withdrawal.In a B2C sale, the right of withdrawal also applies to a standard online auction unless another statutory exception applies. See the Returns and Complaints Policy for details.
10Moderation and reporting content
The Operator may review Listings automatically and manually. It may refuse publication, restrict visibility, remove content, hold a payment or restrict an Account where justified by law, these Terms, User safety or a credible suspicion of fraud. Measures should be proportionate, and the User will receive a statement of reasons where permitted by law.
An illegal Listing or other content may be reported through the contact form by selecting the illegal-content topic. A report should contain:
- the exact URL or content identifier,
- an explanation of why the content is illegal,
- the reporting person’s name and email address unless anonymous reporting is permitted by law,
- a statement that the information is accurate and submitted in good faith.
A moderation decision may be challenged through the contact form. Repeated publication of manifestly illegal content or submission of manifestly unfounded reports may lead to temporary restriction of the service after a prior warning, unless immediate action is justified.
11AI tools and verification
AI outputs, including descriptions, suggested prices and assessments of authenticity features, are provided as assistance and may contain errors. They are not certificates, expert opinions or guarantees of authenticity. The Seller remains responsible for the accuracy of a Listing, and the Buyer should assess all available information.
Where an automated output affects moderation, the Operator may provide human review and a way to challenge the decision. The Privacy Policy explains the processing of photographs, recordings and outputs.
Matchdays currently provides selected Arena skill games with server-checked submissions. Availability, scoring and eligibility may depend on Account or subscription status. Only a result accepted by the Platform server can create a score or points entry; a local animation or client-side message alone creates no entitlement. Further games, promotions and rewards apply only when expressly launched, as described in the Promotions, Points and Games Terms.
12Complaints and disputes
A complaint about operation of the Platform may be submitted through the contact form or to info@matchdays.store. It should include the Account details, a description of the issue, the date of the event and, where relevant, the order or Listing number.
The Operator acknowledges and handles complaints without undue delay, normally within 14 days. Complaints concerning an item itself are directed to the Seller as the party to the sale contract. The Platform’s dispute tool may facilitate exchange of evidence but does not remove any right to go to court, make a statutory claim or request a chargeback where available.
13Data, ranking and intellectual property
Default result ordering may take account of relevance to the query, category, Listing recency, price, Listing activity, and quality and safety signals. Users may use the available sorting options, such as price or date. Paid promotion, if introduced, must be clearly labelled and explained.
A User retains rights in their content but grants the Operator a non-exclusive, royalty-free licence to store, technically process and display it to the extent necessary to provide the services, promote the relevant Listing and prevent abuse. The licence ends when the content is deleted, except for copies required by law, security needs or the defence of claims.
14Suspension and termination
A User may stop using the Platform at any time. The Operator may restrict or terminate a service where there is a breach of law or these Terms, required verification is missing, security is at risk, fraud is suspected or the Account has been inactive for an extended period. Where possible, the decision will be preceded by a warning and include reasons and an appeal route.
Closing an Account does not remove the obligation to complete ongoing transactions, pay amounts due or accept responsibility for earlier breaches.
15Changes to these Terms
These Terms may be changed because of changes to law, security, functions, providers or the fee model. Users will be informed of a material change on a durable medium with appropriate notice. For Sellers acting as traders, the notice period will be at least 15 days unless the law permits a shorter period. A change will not apply retrospectively unless required by law or beneficial to the User.
16Governing law and contact
These Terms are governed by Polish law. This choice of law does not deprive a consumer of protection granted by the mandatory provisions of the country of their habitual residence. Disputes will be determined by the court having jurisdiction under applicable law.
A consumer may seek assistance from a municipal or district consumer ombudsman or an appropriate alternative dispute-resolution body. The EU Online Dispute Resolution platform has been discontinued and is not presented as a complaint channel.
