01Scope and relationship with the Platform Terms
These Seller Terms form part of the agreement between the Seller and Matchdays for use of matchdays.store. The Platform Terms and Conditions, Acceptable Use Policy, Returns and Complaints Policy and Privacy Policy also apply.
Unless a Listing expressly identifies Matchdays as the seller, the Seller contracts directly with the Buyer. Matchdays supplies the online intermediation service and does not take title to the item.
02Eligibility, identity and trader status
A Seller must be at least 18 years old, have legal capacity, be entitled to dispose of every listed item and provide accurate, current details. Matchdays may require identity, address, telephone, payment-account, beneficial-owner, business-registration or tax verification before a Listing is published or a payout is released.
A Seller must truthfully declare whether they act as a private individual or a trader. A trader is a person acting for purposes relating to their trade, business, craft or profession. Regular, organised or profit-oriented selling may amount to trading even without a registered company. Matchdays may correct a status where reliable evidence shows that the declaration is inaccurate.
A professional Seller must provide all business information required to be displayed to consumers. Matchdays may prevent a trader from listing until the information required for trader traceability has been collected and reasonably verified.
03Tax information and DAC7 reporting
Each Seller is responsible for determining and paying their own income tax, VAT, customs charges and other liabilities. Matchdays does not give tax advice.
Where platform-operator reporting rules such as DAC7 apply, Matchdays may collect, verify, retain and report identification and financial information about Sellers and transactions to the competent tax authority. A Seller must provide requested tax identification data and keep it accurate. Where the law permits or requires it, Matchdays may suspend selling or withhold a payout until required information is supplied.
04Listing standards
A Listing must:
- identify the actual item offered and use recent photographs of that item,
- state the item's material characteristics, condition, size, provenance and known defects,
- state whether signatures, certificates, alterations, repairs or reproductions are present,
- show the full price and any delivery charges controlled by the Seller,
- use the correct category and comply with applicable labelling and safety requirements,
- avoid misleading comparisons, hidden keywords and unsupported claims.
Stock photographs may be used only as secondary material where clearly identified. A Seller must promptly update or remove a Listing that is no longer accurate or available.
05Authenticity and intellectual property
Counterfeit goods and deliberately misleading authenticity claims are prohibited. A Seller must have a reasonable evidential basis for claims such as "match worn", "player issued", "signed", "official" or "limited edition" and must retain supporting provenance.
AI assistance, automated checks, a Platform badge or a third-party opinion does not transfer the Seller's responsibility for the Listing and is not a guarantee of authenticity. Matchdays may request additional photographs, LiveCam inspection or independent examination.
The Seller must own or be licensed to use all Listing photographs, descriptions and other content. The Seller grants Matchdays the licence described in the Platform Terms to host, display, format and promote the Listing.
06Product safety and traceability
A trader targeting consumers in the EEA must provide the manufacturer name and contact details, the EU responsible person where required, product identification, an image and applicable warnings or safety information in a language consumers can understand. Equivalent UK product-safety and traceability duties apply where an offer targets the UK.
Unsafe, recalled or unlawfully marketed products must not be listed. Vintage or used status does not remove applicable safety duties. The Seller must promptly notify Matchdays at info@matchdays.store of a recall, serious risk or safety incident and cooperate with corrective action, consumer notification and authorities.
07Sale contracts, auctions and pricing
A Buy Now order or winning auction bid creates a binding sale contract at the point stated in the checkout or auction flow. A Seller must honour the price and terms presented to the Buyer unless there is an obvious error, illegality or a cancellation right imposed by law or expressly provided by the Platform.
Sellers must not bid on their own items, arrange bids that do not reflect genuine demand, cancel to avoid a completed sale, move a Platform transaction off-platform or manipulate price, reviews, ranking or availability.
08Fees, payment processing and payouts
The commission, subscription benefit, payment-processing charge and other fee applicable to a transaction must be displayed before the Seller commits to the chargeable action. Matchdays may deduct agreed fees, refunds, chargebacks and other authorised amounts from sums due to the Seller.
Payments and payouts may be handled by an authorised payment provider under separate terms. The provider may require verification and may delay, reject or reverse an operation under law or its risk rules. Matchdays will not describe funds as escrow unless a legally and technically valid escrow arrangement has actually been deployed.
09Packaging, shipping and delivery
The Seller must dispatch within the time shown in the Listing, use suitable protective packaging, provide accurate tracking and retain proof of posting and delivery. Valuable or unique items should use a tracked service with appropriate insurance and signature confirmation.
The Seller is responsible for customs descriptions and documents they prepare. A shipping label generated through Matchdays does not remove the Seller's responsibility for the parcel or compliance with carrier restrictions.
10Professional Sellers and consumer rights
A trader selling to a consumer must provide all mandatory pre-contract information, a durable confirmation of the contract, a lawful withdrawal process and remedies for goods that do not conform to the contract. Mandatory rights cannot be excluded by a Listing or by these Seller Terms.
A standard auction conducted only online is not treated as a public auction solely because it uses bidding. Consumer withdrawal rights may therefore apply. The Returns and Complaints Policy explains the distinction between B2C and private C2C sales.
11Returns, complaints and disputes
The Seller must respond promptly and in good faith to a Buyer complaint, preserve evidence and comply with mandatory refund, repair, replacement or price-reduction duties. The Seller must not ask a Buyer to close a dispute, provide a misleading declaration or return an item outside the documented process as a condition of assistance.
Matchdays may facilitate evidence exchange or communicate a decision to a payment provider where the deployed transaction flow permits it. This does not make Matchdays the seller or remove either party's right to use a court, regulator, ADR body or lawful payment remedy.
12Ranking, promotion and differentiated treatment
Default ranking may consider relevance, category match, recency, Listing completeness, price, engagement, Seller performance, delivery reliability, safety signals and fraud risk. Their relative importance varies by query and service objective. A paid featured placement or subscription-based visibility advantage must be clearly labelled and may improve prominence but does not guarantee a sale.
Matchdays may give its own services or verified campaigns different visual treatment where this is clearly identified. Matchdays does not require a Seller to offer the lowest price or restrict lawful sales through other channels, but the Seller must not use Platform data or communications to evade an agreed fee on a transaction initiated here.
13Checks, restrictions and appeals
Matchdays may reject, demote, suspend or remove a Listing, restrict a feature or suspend a Seller where reasonably necessary for law, product safety, authenticity, security, fraud prevention or enforcement of these Terms. Where required, Matchdays will provide the affected Seller with a clear statement of reasons and an available appeal channel, except where law or an investigation prevents disclosure.
A Seller may challenge a decision through Contact. Business users may also use mediation or other redress mechanisms where applicable law requires them.
14Records and cooperation
Sellers must retain transaction, provenance, safety, dispatch and tax records for the periods required by law and provide relevant records when reasonably needed to investigate fraud, a counterfeit claim, product safety issue, payment dispute or authority request.
15Changes and termination
Material changes affecting business users will be notified on a durable medium with the notice required by applicable law, normally at least 15 days. A longer period will be used where technical or commercial adaptation reasonably requires it. Immediate changes may be made where legally required or necessary to address an unforeseen security or fraud risk.
Ending the Seller relationship does not cancel completed sales, unpaid fees, open returns, reporting duties or liabilities arising before termination.
